Common Law is legal philosophy decl ard by the judge. These fairnesss are applied based on customs and judicial precedents developed over hundreds of years in Britain. These laws were imported as the law of British colonies throughout the world such as the United States of America ( unpack Louisiana), Canada (except Quebec) and India. (Duhaime.org).
Common law systems are in truth complicated. The United States is a vulgar law country. All advances except for Louisiana are common law states. Common law has no statutory basis; judges establish common law through written opinions that are binding on future decisions of lower courts in the same jurisdiction. Broad areas of the law, nearly notably relating to property, contracts and torts are traditionally part of the common law. These areas of the law are mostly at bottom the jurisdiction of the states and thus state courts are the primary source of common law. Thus, common law is used to take in gaps. Common law changes over time, and at this time, separately state has its own common law on some topics. Jurisdiction over Persons or In Personam. This type of jurisdiction has jurisdiction over parties to a lawsuit.
Personal Jurisdiction over Corporation. Since familiaritys may also be considered legal persons, a court may apply the same principles as it would a person.
